Italy calls its personal over-indebtedness framework sovraindebitamento (literally "over-indebtedness") and governs it through the Codice della crisi d'impresa e dell'insolvenza (CCII), enacted as Decreto Legislativo 14 del 12 gennaio 2019 (D.Lgs. 14/2019), published in Gazzetta Ufficiale n.38 of 14 February 2019 and fully in force from 15 July 2022. What it is called

Who can use it

Ristrutturazione dei debiti del consumatore is available exclusively to a consumatore -- a natural person acting for purposes unrelated to any business, trade, craft or professional activity (Article 2 D.Lgs. 14/2019, verified via normattiva.it). A person who holds membership in a company may still qualify as a consumer provided they are seeking relief specifically for debts unrelated to that membership. Concordato minore is reserved for over-indebted professionals, minor entrepreneurs, agricultural entrepreneurs, and innovative start-ups. Article 74 of D.Lgs. 14/2019 (verified via normattiva.it) explicitly excludes consumers from this procedure. Liquidazione controllata is open to any over-indebted debtor -- consumer or non-consumer -- whose assets cannot cover outstanding liabilities. How the process works

Ristrutturazione dei debiti del consumatore: the consumer, assisted by an OCC, prepares a restructuring plan and files it with the single-judge tribunal. Required documentation (Article 67 CCII, verified via normattiva.it) includes: a full creditor list with amounts and priorities; a complete asset inventory; a record of unusual transactions from the past five years; three years of tax returns; and a statement of income sources and family maintenance needs. The plan may partially reduce debts (falcidia), restructure secured-debt instalments, and defer primary-residence mortgage payments by up to two years after court approval. Creditors who themselves contributed to the debtor's over-indebtedness through their own fault cannot oppose homologation (court approval) of the plan (Article 69 CCII, verified via normattiva.it). Liquidazione controllata: the court opens proceedings on the petition of the debtor or a creditor, appoints a liquidator from the OCC, and suspends accrual of conventional and legal interest on all unsecured claims from the date of filing (Article 268 CCII, verified via normattiva.it). The liquidator manages and realises all realisable assets -- excluding wages required for family support and other legally non-attachable credits -- and distributes proceeds to creditors in order of priority. Concordato minore follows broadly similar procedural steps to the ristrutturazione but is designed to allow continuation of professional or entrepreneurial activity; it requires either that the debtor continues the activity or that external resources are brought in to increase the available estate (Article 74 CCII, verified via normattiva.it).

How long it lasts and the outcome

Ristrutturazione dei debiti del consumatore: the duration is determined by the repayment schedule in the approved plan. Successful completion of all plan obligations extinguishes the remaining included debts by operation of law. Liquidazione controllata and esdebitazione del debitore incapiente: the discharge (esdebitazione) operates following the closure order of the liquidation or, if earlier, after three years from the opening of the procedure (Article 282 CCII, verified via normattiva.it). The discharge decree is entered in the business register and published on the court's dedicated website; creditors have 15 days from publication to file observations. Effect of discharge: the debtor is liberated from all remaining unpaid debts owed to creditors who participated in the procedure (Article 278 CCII, verified via normattiva.it). The following debts survive discharge and remain fully enforceable: maintenance and support obligations (alimony, child maintenance); damages arising from unlawful acts (civil tort liability); and criminal or administrative financial sanctions not ancillary to discharged debts (Article 278 CCII).
